Terms and Conditions for Our Service and Rebates

Disambiguation/Definition of Key Words and Phrases

“Rebate” – A rebate is a portion of the commission we earn from the apartment management companies that we return to you as a thank you for listing Signature Apartments Locator in the referral section of your apartment application/guest card.

“Commission” or “Broker Commission” – This is the payment we receive from the apartment management companies for referring you to their property. Most properties pay us a broker commission of 50% – 100% of one month of your rent. You do not have to pay our commission, the apartment management companies pay us for referring you.

“Apartment Management Company” – This is the company that either owns or manages the apartment communities that we refer clients to. These companies pay us broker commissions as compensation for our work by referring you to rent an apartment at their property.

“Apartment MLS” – MLS stands for Multiple Listing Service. We use the MLS service ApartmentData.com who provide apartment pricing, availability and other information about apartments that match your search criteria.

User Rights and Responsibilities

Proper or Expected Usage; Potential Misuse – Our service is always free for you to use. We will contact you within 24 hours of your submission of your information on the contact form on our website. After three unsuccessful attempts to contact you we will close out your file. It is important that you provide correct contact information so that we can reach you with any questions we may have concerning your search criteria. A potential misuse of our service is giving us incorrect information when submitting your search criteria. Other potential misuse is if you knowingly or willingly lie or omit information required on our contact form.

Accountability for Online Actions, Behavior, and Conduct – Our agents will always act in a professional manner and do our best to find you a great apartment. We also expect our clients to behave in a respectful manner. We promise to put the interests of the client above all others, including the broker’s own interests. We will inform the client of any material information about the property or transaction received by the broker. We will answer the client’s questions and present any offer to or counter-offer from the client. We will treat all parties to a real estate transaction honestly and fairly.

Privacy Policy Outlining the Use Personal Data – The information you submit on our website may be used in the future to contact you about real estate services or other services and/or products offered by Signature Apartments Locator or our partner organizations. Any solicitations will always include an opt-out or unsubscribe option. See Opt-out policy detailed below.

Rebate Payment Details – Any rebate offer is subject to the consent of the principals our Texas licensed real estate agents represent. We will pay a rebate to clients in the amount of $300 for listing your agent name and Signature Apartments Locator on the referral section of your apartment guest card/application. We will attempt to pay your rebate check once your apartment complex pays us. This is typically between 60-90 days after your move-in date, but the timing can vary depending on your apartment management company policies. We require that you sign a minimum of a 12+ month lease in order to qualify for the $300 rebate amount. We cannot guarantee payment of any rebate with a lease under 12 months because many apartment management companies will not pay us a commission for short-term leases. We also cannot guarantee payment of any rebate if you have moved from one property to another managed by the same apartment management company. Most apartment management companies will not pay broker commissions to us when you transfer to another property that they manage. We will also not pay a rebate check if you break your lease agreement with your apartment management company or if you are evicted. If we have already paid you a rebate check and then you break your lease agreement with your apartment management company or are evicted we reserve the right seek a refund of the full amount we have paid you through your rebate.

Opt-out Policy Describing Procedure for File Termination – Please let us know via email if you would like for us to close out your file at any time. We appreciate it when clients let us know whether or not they still want us to contact them in the future. We will periodically contact you in the future about real estate services or other services and/or products offered by Signature Apartments Locator or our partner organizations should you not notify us in writing of your desire to opt-out from future communication. Any solicitations will always include an opt-out or unsubscribe option.

We are not liable for any disagreements and or contract disputes you may have with your apartment management company. Our service is limited to providing you with a list of apartments that match your search criteria, answering any questions you may have about prospective properties or the process, and paying you a rebate check if you comply with the terms and conditions described in this document. You are the one that makes the final choice on which property to rent – we do not make that decision and are not responsible for any problems you may have as a result of that decision. We will only provide you with the information we have through the apartment MLS ApartmentData.com. Please note that apartment pricing and availability are subject to change at any time and we are not liable for any discrepancies that may or may not appear on the apartment MLS. We will always act in accordance with the rules of the Texas Real Estate Commission (TREC) when dealing with clients.

Qualification guide lines

  • Your rental rate must be $900 or above to be eligible for our $100 rebate offer.
  • Your rental rate must be $1500 or above to be eligible for our $200 rebate offer.
  • Your rental rate must be $2000 or above to be eligible for our $300 rebate offer.
  • You must have never before lived in the community where you lease.
  • Your rental rate will be based on the effective average rent after specials.
  • You must lease at a community found on our website, via our online apartment-locating search tool, or at a community referred to you by one of our licensed agents.
  • You must not be transferring (on-site transfer) from within the same property.
  • You must sign at least a 7-month lease to be eligible for the rebate offers.
  • All Rebate requests must be submitted within 60 days of your lease start date.
  • Signature Apartments only allows one (1) rebate offer per apartment.
  • In the event a participating community's referral fee falls below our minimum requirements, Signature Apartments reserves the right to offer a reduced rebate offer. Referral fees for individual properties can change without notice.
  • If for any reason a property decides not to pay our referral commission, this will constitute a retraction of our rebate offer.
